Questions are being widely raised about whether such a move is even possible. However, the proposed law is set to be tabled in Parliament, and if passed, it could be implemented.<\/p>\n

The Commission for the Investigation of Abuse of Authority (CIAA) has begun preparations to investigate business activities in the private sector. The aim is to ensure good governance across all sectors by expanding oversight to include private business operations.<\/p>\n

On the positive side, if implemented properly, such investigations could help prevent abuse of power, improve transparency, and strengthen public trust. However, there are also concerns about potential negative impacts, including fear in the private sector, reduced investment, and uncertainty in the business environment. Therefore, any such move must be carried out in a balanced, fair, and legally sound manner.<\/p>\n

The effectiveness of this initiative will largely depend on its implementation, particularly on judicial fairness, transparency, and respect for legal boundaries. If conducted impartially and based on clear evidence, it could help control corruption, ensure accountability, and promote social justice. But if misused for political or personal interests, it could undermine business confidence, reduce investment, and hinder economic growth.<\/p>\n

Past experiences suggest such policies can significantly affect the mindset of the private sector. In a country like Nepal, maintaining complete records of privately earned wealth is often difficult, which could further complicate enforcement. If previous cases involved misuse, corruption, or political interference, investors and entrepreneurs may feel increased fear and caution.<\/p>\n

According to the CIAA\u2019s Second National Anti-Corruption Strategic Plan, the government aims to criminalize corruption-related activities across all sectors. Legal and policy reforms will allow corrective measures for certain offenses, except in cases involving state losses or illicit gains.<\/p>\n

The strategy includes measures to prevent corruption in cooperatives, public-private companies, and other private organizations. Within two years, a new anti-corruption law is planned, which will define corruption in the private sector, specify offenses and penalties, and establish responsible bodies for investigation, prosecution, and adjudication.<\/p>\n

Additionally, all forms of irregularities and corruption in companies, partnerships, private organizations, and cooperatives will be discouraged. The government also plans to amend existing laws, including provisions related to property transactions under the Civil Procedure Code, to better regulate private sector activities.<\/p>\n

The CIAA also intends to criminalize bribery in private sector financial and business transactions. New legal provisions will make both giving and receiving bribes punishable, along with necessary amendments to existing laws.<\/p>\n

Further plans include stricter legal action against private entities involved in embezzlement or damage to public property, with harsher penalties expected within two years. To improve transparency in share transactions, the government proposes mandatory verification of records for share purchases exceeding NPR 1 million, including proof of payment through bank statements, vouchers, or cheques.<\/p>\n

The strategy also outlines amendments to company directives, development of codes of conduct to prevent conflicts of interest, strengthening internal audits and controls, and monitoring compliance with accounting and auditing standards.
